Terms of Sale

Effective Date: January 1, 2025

Thank you for choosing Tile Topic (“Tile Topic,” “we,” “us,” or “our”). These Terms of Sale (“Terms”) govern all purchases from Tile Topic, whether through our website tiletopic.com (“Site”), over the phone, via email, or any other channel. By placing an order, you (“Customer,” “you,” or “your”) acknowledge and agree to these Terms.

1. Product Variation and Disclaimer

Inherent Characteristics: All tiles sold by Tile Topic may show variation in color, shade, size, and finish. These inherent characteristics are part of the tile’s beauty and are not defects.

Nominal Sizing: The stated tile dimensions are nominal. Slight differences are normal and expected.

Customer Responsibility: It is your responsibility to understand and follow all installation instructions, including any sealing or maintenance guidelines applicable to the type of tile purchased. Tile Topic is not responsible for issues arising from improper installation or maintenance.

2. All Sales Are Final

No Returns or Exchanges.

All Sales Final: Once payment is received, all sales are considered final.

Cancellation Window: You may request a cancellation or change to your order within six (6) hours of the time of order receipt. After that time, no cancellations or modifications can be accommodated as inventory is allocated and set aside for your order.

Custom / Special Orders.

No Cancellations: Custom or special orders (non-stock items or made-to-order tile) are never cancellable once production begins.

No Refunds: Absolutely no refunds or exchanges on custom/special orders.

3. Payment, Taxes, and Pricing

Payment Requirements

Upfront Payment: Full payment (100%) is due at the time of order placement, unless otherwise agreed in writing.

Payment Methods: We accept major credit cards, PayPal, or other payment methods indicated at checkout.

Taxes and Duties

Applicable Taxes: Sales tax (and any duties for international orders) will be added at checkout as required by law.

Other Charges: The Customer is responsible for any destination fees, duties, or clearance charges.

Pricing Errors

If we discover a pricing or shipping-rate error, we reserve the right to refuse or cancel the order, even after payment has been received. A full refund will be issued if your order is canceled due to such an error.

4. Ordering and Lead Times

In-Stock Products

Typically ship within 2–3 business days once payment is received and stock is confirmed.

Custom / Special Orders

Production timelines and estimated arrival dates vary depending on manufacturer schedules, import processes, customs inspections, and port congestion.

We do not guarantee exact delivery dates for custom or special orders due to the nature of international logistics.

One-Shipping Policy

Orders with multiple lead times will ship together once all tiles are in our warehouse. If you prefer split shipments, additional shipping fees may apply.

No Guarantees

While we strive to meet or reduce projected lead times, no guarantees are provided due to the custom and international nature of many of our tiles.

Order Quantities and Overage

Customer-Provided Measurements

You are solely responsible for providing accurate measurements and quantities. We strongly advise consulting a professional installer for precise calculations.

Recommended Overage

We strongly recommend ordering 15–20% more tile than your project requires to account for cuts, potential breakage, and color matching.

For larger tiles (24”x48” or bigger), consider an even higher overage.

Risk of Under-Ordering

If you need more tile later, we cannot guarantee that the exact style, color lot, or finish will be available. Additional lead times and costs may apply.

6. Shipping and Delivery

i. Methods and Coverage

We ship throughout the U.S., Canada, and internationally (upon request). Domestic orders generally ship via LTL (Less Than Truckload) freight.

ii. Curbside Delivery

Standard freight deliveries are “curbside.” The carrier delivers your pallet(s) to your location’s curb but does not move them into a building or up stairs. Arrange for extra help to transport the tile from curbside to the final destination.

iii. Scheduling

The freight company will contact you to schedule a specific delivery time. You or your representative must be on-site to accept and sign for the delivery.

iv. Missed Deliveries

If you are absent for a scheduled delivery or refuse shipment, the carrier may charge additional storage or re-delivery fees. These fees are your responsibility.

v. Transit Delays

Tile Topic is not liable for delays caused by shipping carriers, customs, port congestion, weather, acts of God, or any events beyond our control.

7. Damages and Claims

i. Inspection at Delivery

Inspect your shipment immediately upon receipt. Check for shortages or visible damage and compare against the packing slip.

ii. Notate Damage on BOL

If you notice damaged boxes or missing items, note this clearly on the Bill of Lading (BOL) and take photos before the driver leaves.

iii. Claim Window

48 Hours: You must contact us at [email protected] within 48 hours of delivery to report any damage or shortages. Include photos of damaged tiles and the outer packaging.

iv. Minor Breakage

A small percentage (up to 5%) of chipped or cracked tiles can often be used for cuts. This is standard in the tile industry and is not considered a defect.

v. Resolution

We will work promptly to replace or remedy any damaged items once your claim is received with proper documentation.

Important: Any damage claims submitted after 48 hours of delivery cannot be honored, and installation of damaged product constitutes acceptance of the tiles “as is.”

8. Installation, Care, and Maintenance

A. Hire a Professional

We strongly recommend working with a professional installer familiar with the specific tile type and industry best practices.

B. Following Instructions

Detailed installation guides and tile specifications may be provided on our Site or upon request. You must follow all sealing and grouting instructions, especially for cement, natural stone, or other porous tiles.

C. No Liability after Installation

Tile Topic is not responsible for issues arising from installation methods, ongoing maintenance, or improper use of cleaning products.

Once tile is installed, you have accepted the product.

D. Suggested Cleaning

We recommend using pH-neutral cleaners. Avoid harsh chemicals, acids, or abrasive pads that can damage tile surfaces.

9. Storage

A. Free Storage Period

We offer up to four (4) weeks of free storage from when your tiles arrive in our warehouse.

B. Storage Fees

If you are unable to accept delivery beyond this 4-week period, storage fees of up to 25% of your order value may apply.

C. Long-Term Storage

After 6 months of warehousing your tiles, we reserve the right to cancel your order, restock the materials, and issue a store credit for the amount paid minus any applicable storage and restocking fees.

10. Disclaimer of Warranties; Limitation of Liability

i. No Warranties

All products are provided “as is” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

B. Limitation of Liability

To the fullest extent allowed by law, Tile Topic shall not be liable for any direct, indirect, consequential, special, or incidental damages resulting from purchase, use, or installation of our products. Tile Topic’s total liability shall not exceed the amount you paid for the specific items giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tile Topic, its employees, directors, and affiliates from any and all claims, demands, or damages (including legal fees) arising out of your breach of these Terms, your improper use of our products, or any violation of law or third-party rights.

12. Governing Law and Dispute Resolution

These Terms and any disputes arising hereunder shall be governed by the laws of the Province of Ontario, and the laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in the Province of Ontario for the resolution of any disputes.

13. Changes to these Terms

We reserve the right to update or modify these Terms at any time by posting an updated version on tiletopic.com. Your continued use of our Site or purchase of our products after any such update constitutes your acceptance of the modified Terms.
